Welcome to GameTrade’s Terms of Service, thoughtfully prepared by Terminus the Scribe, Guardian of Agreements in our Legal Department. (Learn more about our Guardians at Legal Department.) These terms outline your rights and responsibilities when using the GameTrade Platform. By using the GameTrade Platform, you agree to these terms, forming a binding contract with GameTrade Limited. If you disagree, please refrain from using the Platform. 

We may update these Terms, with changes effective immediately after posting on the Platform. Continued use post-update signifies acceptance. Check regularly or contact Terminus at [email protected] for clarification.


1. General

This Terms of Service (“Agreement”) governs your use of the GameTrade Platform (website, mobile site, or mobile application) and related services. It applies to all users, including Buyers and Sellers, and complies with Hong Kong’s Trade Descriptions Ordinance (Cap. 362), Sale of Goods Ordinance (Cap. 26), Personal Data (Privacy) Ordinance (Cap. 486), and Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615).


1.1 Eligibility

The Platform is for:

  • You must be at least 18 years old and legally capable of entering into binding contracts. If you are under 18, you may only use the Platform with the consent and supervision of a parent or legal guardian, who accepts this Agreement on your behalf and assumes responsibility for your actions.
  • Users not in sanctioned countries (e.g., UN/OFAC lists) or designated as terrorists under Hong Kong’s United Nations (Anti-Terrorism Measures) Ordinance (Cap. 575).
  • Users who confirm they are not barred from using similar platforms under any jurisdiction's laws.
  • The Platform is not accessible to employees, agents, or affiliates of game publishers or developers to prevent conflicts of interest.

1.2 GameTrade’s Role

GameTrade operates as a neutral intermediary platform facilitating transactions between Buyers and Sellers. GameTrade does not own, control, create, or endorse Items listed on the Platform and is not a party to Sale Contracts unless expressly stated. GameTrade is not affiliated with any game publisher or developer and does not represent or warrant the transferability, ownership, or continued usability of Items in any game. Users warrant that all Items listed or purchased comply with applicable laws, game developers’ terms of service, and do not infringe third-party intellectual property rights, including copyrights, trademarks, or patents. Users indemnify GameTrade against any claims, losses, or liabilities arising from their listings, transactions, or violations of game developer agreements, including account bans or legal actions by third parties. GameTrade shall not be liable for any sanctions, penalties, account suspensions, item revocations, or other measures imposed by game developers or third parties arising from user transactions. 2. Definitions

  • Account: Your registered account to access the Platform.
  • Buyer: A user purchasing Items.
  • GT Credit: Virtual currency for Platform purchases, non-redeemable for cash except in cases where a refund is issued due to transaction cancellation as per the Transaction Policy.
  • GT Points: Non-transferable loyalty points convertible to GT Credit.
  • Item: In-game assets, virtual currencies, accounts, or services listed for sale.
  • Seller Wallet: Seller Wallet that stores sale funds, with payouts available according to the Seller Code of Commerce.
  • Payment Partner: Licensed providers handling payments.
  • Platform: GameTrade’s website, mobile site, or mobile application.
  • Personal Data: Data as defined in the Privacy Policy.
  • Sale Contract: Agreement between Buyer and Seller for Item purchase.
  • Seller: A user listing Items for sale.
  • User/You: All Platform users (Buyers, Sellers, or visitors).

3. Access to the Platform

3.1 Account Creation

Create an Account via the Registration Process. GameTrade may conduct Electronic Know Your Client (EKYC) checks for security and compliance with Hong Kong’s AML/CTF laws. Provide accurate verification documents (e.g., government-issued ID, passport) when requested. Non-compliance may lead to Account suspension or transaction cancellation.


3.2 Account Security

  • Keep your username and password confidential. Notify GameTrade immediately of unauthorized access at [email protected].
  • Any actions or instructions issued from your Account will be considered as having been made by you, even if performed by a third party. You are solely responsible for maintaining the confidentiality of your login credentials.
  • Each user is limited to one Account. Creating accounts for others or impersonation may result in suspension and reporting to authorities

  • Users assume all risks associated with sharing Gaming Account credentials during transactions and indemnify GameTrade against losses from unauthorized access to external accounts.

3.3 Account Monitoring

Monitor your Account for unusual activities or errors. Notify GameTrade within 7 days of:

  • Abnormal transactions or inaccurate records.
  • Incomplete or garbled data from GameTrade.
  • Unauthorized access or security breaches.
  • Data not intended for you (do not use or disclose without consent).

3.4 Username and Profile Picture Restrictions

Usernames and profile pictures must not incorporate the GameTrade name, logos, or any offensive, obscene, or inappropriate content, as determined by GameTrade at its sole discretion. Usernames and profile pictures must not infringe third-party trademarks (e.g., game logos). GameTrade, under the guidance of Terminus the Scribe, reserves the right to change, remove, cancel, or adjust usernames and profile pictures that violate this policy or harm the Platform’s reputation. Violations may result in immediate Account suspension or permanent bans, with notification sent to [email protected].


4. For Buyers

4.1 Transactions

GameTrade may limit transaction amounts for security and may refuse transactions violating these Terms or applicable laws.

4.2 Responsibilities

Buyers must:

  • Review Item listings carefully before purchase, ensuring compliance with game developers’ terms of service. Buyers acknowledge that purchasing Items may violate game terms, resulting in risks such as account bans or Item loss, for which GameTrade is not liable.
  • Use only their own funds and payment accounts; third-party payment accounts are prohibited.
  • Confirm Item receipt promptly within 24 hours of delivery, reporting discrepancies to [email protected] per the Transaction Policy.
  • Conduct all communications and transactions solely through the Platform. Off-platform transactions (e.g., via Discord, private chats) are prohibited and void GameTrade’s protections, including refunds. Evidence from off-platform communications is not admissible in disputes.
  • Not return purchased Items to Sellers, even with mutual agreement, as this may be exploited for fraudulent purposes (e.g., bot-assisted scams). GameTrade does not issue refunds for returned Items unless the Buyer contacts the Support Team in advance and receives written confirmation authorizing the return.

By purchasing Items, Buyers represent and warrant that such actions do not infringe any Third-Party Rights, including those of game developers.


4.3 Payment Processing

  • Payments are processed by Payment Partners per their terms. You authorize GameTrade and Payment Partners to charge your provided payment method for purchases, subscriptions, or fees. 
  • Buyers may need to provide additional information (e.g., government-issued ID, payment method details, or proof of address) to verify identity and comply with Payment Partner requirements or AML/CTF regulations. GameTrade may verify Buyer and Seller details to prevent fraud, including requesting additional ID documents or security procedures. 
  • If a Buyer declines to complete the identity verification process, GameTrade will refund the principal payment amount - excluding any payment gateway fees - within 10 business days using the original payment method, unless otherwise agreed.
  • GameTrade reserves the right to cancel or suspend any transaction at any stage if suspected of being fraudulent, illegal, or in violation of these Terms or game developers’ terms of service, without liability. 
  • Buyers and Sellers must conduct all communications and transactions solely through the Platform; off-platform interactions (e.g., via private chats) are prohibited, and only in-platform communications are valid for dispute resolution. 
  • Buyers must not return purchased Items to Sellers, even with mutual agreement, as this may constitute fraud (e.g., automated scams in specific games). No refunds will be issued for returned Items, except in cases where Buyers notify the GameTrade Support Team at [email protected] prior to any return and receive confirmation from the GameTrade Support Team for such return. Funds are released to Sellers’ Seller Wallets upon:  
    • Your confirmation of Item receipt. 
    • Failure to confirm within 3 days (deemed received).
    • Dispute resolution or legal order.

5. For Sellers

5.1 Eligibility [IMPROVED]

To become a Seller, you must:

  • You must be at least 18 years old to become a Seller. If under 18, you may register only with the consent of a parent or legal guardian, who accepts this Agreement on your behalf and assumes responsibility for your actions.
  • Possess the legal capacity to enter binding contracts under applicable laws.
  • Not be located in a sanctioned country (e.g., UN/OFAC lists) or designated as a terrorist under Hong Kong’s United Nations (Anti-Terrorism Measures) Ordinance (Cap. 575).
  • Comply with all GameTrade policies, including the Seller Policy and General Prohibitions Policy. GameTrade, under the oversight of Terminus the Scribe, may reject Seller applications at its sole discretion, including for incomplete applications, suspected fraud, or non-compliance with legal or Platform requirements.

5.2 Seller Application and Verification 

  • To become a verified Seller, complete a detailed application form via the Platform, providing accurate personal information (e.g., full name, contact details) and verification documents (e.g., government-issued ID, proof of address) as requested. 
  • Sellers undergo enhanced verification, including Electronic Know Your Client (EKYC) checks, to ensure compliance with Hong Kong’s AML/CTF laws and GameTrade’s security standards. Non-compliance may result in application rejection or Account suspension. 
  • Sellers must provide a payout account in their own name. The account name must match the name registered on their GameTrade Account and be written in the English alphabet to ensure verification
  • Usernames and profile pictures must not incorporate the GameTrade name, logos, or any offensive, obscene, or inappropriate content; violators will face immediate Account suspension. 
  • Sellers are prohibited from sharing personal communication channels (e.g., private chats, Discord) with Buyers or conducting transactions outside the Platform. Off-platform transactions void GameTrade’s TradeGurd Policy and may result in permanent Account suspension without reinstatement.

5.3 Listing Items

  • Sellers must provide accurate, legal Item descriptions that comply with game developers’ terms of service and applicable laws. Listings violating the General Prohibitions Policy (e.g., illegal, infringing, or unauthorized items) will be removed, and Sellers may face Account suspension. Sellers must ensure they have legal rights to sell listed Items. By listing Items, Sellers represent and warrant that such actions do not infringe any Third-Party Rights, including those of game developers. Sellers must provide proof of compliance with game end-user license agreements (EULAs) upon request; failure to do so may result in rejection or removal. Sellers are prohibited from using automated tools (e.g., bots for farming or scraping) in listings or deliveries.

5.4 Delivery 

  • Sellers must deliver Items within 24 hours of payment confirmation unless otherwise specified in the listing. Proof of delivery (e.g., screenshots or videos) must be uploaded to the order page. GameTrade reserves the right to cancel or reassign orders if Buyers are dissatisfied, to ensure customer satisfaction and compliance with these Terms. See Seller Code of Commerce.

5.5 Seller Ranking 

  • Seller rankings are determined based on transaction history and Buyer feedback, impacting fees and listing visibility. Repeated errors or failure to meet obligations may result in rank reduction or, for persistent non-compliance, removal from the Seller list, as determined by GameTrade at its sole discretion.

6. Service Fees

6.1 Fees for Sellers

  • Transaction Fees: Sellers are subject to service fees on each successful sale. The commission rate varies depending on the Seller’s rank within the Platform, with higher-ranked Sellers enjoying reduced fees. All transaction fees are automatically deducted from the Sale Contract Sum prior to payout.
  • Withdrawal Fees: Withdrawal fees depend on the selected payment method and may include fixed or variable charges. A minimum withdrawal threshold applies.
  • Other Fees: Additional fees may be incurred for optional premium services, such as featured listings or promotional tools. All service fees are non-refundable.

6.2 Fees for Buyers

  • Payment Gateway Fees: Buyers may incur payment processing fees based on the payment method and provider selected at checkout. These fees are determined by the Payment Partner and may vary depending on location, currency, and transaction type. All applicable fees are clearly displayed before payment is confirmed.

6.3 Taxes and Obligations

  • Users (Buyers and Sellers) are solely responsible for any taxes, fees, or obligations arising from their use of the Platform or contracts made through it, including under Hong Kong’s Inland Revenue Ordinance (Cap. 112) or other applicable laws.
  • GameTrade does not calculate, collect, or remit taxes on behalf of users. You are solely responsible for determining and fulfilling your tax obligations under applicable laws, including reporting income and paying taxes to the relevant authorities.
  • GameTrade is not responsible for settlement fees, unpaid issues, or tax disputes between users or with third parties.

6.4 Payment Issues

  • For failed or overdue payments, GameTrade reserves the right to use alternative methods, including charging additional fees.

7. Sale Contract

7.1 Nature

Sale Contracts are between Buyers and Sellers, excluding GameTrade. We don’t guarantee Item quality, legality, or delivery, nor are we liable for losses from Sale Contracts, including game developer actions (e.g., bans).


7.2 Obligations

  • No modification/cancellation of Sale Contracts without GameTrade’s written consent, indemnifying us for losses.
  • Perform Sale Contracts diligently and comply with GameTrade’s guidelines.

7.3 Risks

Buyers and Sellers bear risks, including non-delivery, account issues, or game developer modifications. Conduct due diligence before transacting. Risks include infringement claims by game developers, for which users bear sole responsibility and agree to defend GameTrade.

7.4 Transaction Risks

Users acknowledge comprehensive risks associated with transactions, including fraudulent schemes, defective Items, and Third-Party Rights infringement claims. Users assume all such risks, and GameTrade disclaims any liability for them.


8. General Obligations

  • Comply with all applicable laws, including Hong Kong’s Personal Data (Privacy) Ordinance (Cap. 486) and AML/CTF regulations.
  • Obtain necessary licenses/permissions for your activities.
  • Follow GameTrade’s policies and instructions.

9. Use of the Platform

GameTrade grants a non-exclusive, non-transferable license to use the Platform for this Agreement’s purposes. You shall not:

  • Copy, modify, or distribute Platform content without permission.
  • Reverse-engineer, decompile, or hack the Platform.
  • Use the Platform for fraud, illegal activities, or to harvest data.
  • Interfere with Platform operations or other users’ enjoyment.

10. Information Submitted

  • Ensure all submitted Information is accurate, legal, and non-infringing.
  • Do not post unlawful, harmful, or objectionable content.
  • By submitting content to the Platform (excluding Personal Data as defined in the Privacy Policy), you grant GameTrade a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute such content for operational and promotional purposes.

11. Consent to Communications

You consent to receiving emails, SMS, or Platform notifications for announcements and promotions. Opt out via settings or [email protected].


12. Policies

Comply with all GameTrade policies (e.g., TradeGuard, Transaction Policy, Privacy Policy), which form part of this Agreement.


13. Third-Party Links

GameTrade isn’t responsible for third-party sites/content linked on the Platform. Use them at your own risk.


14. Personal Data

Personal Data is processed per the Privacy Policy and Hong Kong’s Cap. 486. You must comply with these rules and notify GameTrade of any data breaches.


15. Confidentiality

15.1 Definition

“Confidential Information” includes technical data, trade secrets, and business details shared by GameTrade, excluding information you already possessed, independently developed, or publicly available.


15.2 Obligations

  • Do not disclose Confidential Information without GameTrade’s consent, except as required by law or to authorized advisors.
  • Notify GameTrade before legally required disclosures to allow protective measures.
  • GameTrade may share your contact details with Buyers/Sellers for Sale Contracts.

This clause survives termination.


16. Intellectual Property

16.1 Ownership

GameTrade and its partners retain all Intellectual Property Rights. No rights are transferred to you. GameTrade does not acquire title to any virtual Items and disclaims all liability for intellectual property disputes arising from user content.


16.2 Usage

Do not infringe GameTrade’s or third-party Intellectual Property Rights. For copyright issues, see the Copyright Policy. By listing or purchasing Items, users represent and warrant that such actions do not infringe any third-party intellectual property rights, including those of game developers.


16.3 Game Content

Game trademarks and content belong to their developers. GameTrade doesn’t endorse or affiliate with them.


17. Consumer Protection

Under Hong Kong’s Trade Descriptions Ordinance (Cap. 362) and Sale of Goods Ordinance (Cap. 26), Buyers may:

  • Request exchanges for defective or misdescribed Items.
  • Request refunds if exchanges are not feasible. Requests must be submitted via [email protected]
  • Buyers must report any discrepancies or issues with purchased Items within 24 hours of delivery. Failure to report within this timeframe will result in forfeiture of eligibility for review, refund, or exchange. GameTrade will respond to requests within 7 days, with approved refunds processed within 7 days to GT Credit or the original payment method. Fraudulent claims will void all protections. See the Transaction Policy for details. 

18. Warranty and Disclaimer

GameTrade provides services with reasonable care but doesn’t guarantee:

  • Platform functions meet your needs.
  • Uninterrupted or error-free operation.
  • Virus-free or secure access.
  • Third-party Information (e.g., Seller listings) isn’t guaranteed for accuracy. Use the Platform at your own risk. GameTrade disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. No representations are made regarding the accuracy, reliability, or legality of user listings or third-party content.

19. Limitation of Liability

To the extent permitted by law:

  • The Platform is “as is” without warranties beyond those stated.
  • GameTrade isn’t liable for losses from third-party actions, game developer changes, or Platform unavailability.
  • GameTrade excludes liability for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business interruption, even if advised of the possibility thereof. In no event shall GameTrade’s total liability to you exceed the greater of USD 100 or the total amount of fees you paid to GameTrade in the twelve (12) months preceding the claim. 

20. Indemnity

You agree to indemnify, defend, and hold harmless GameTrade and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of this Agreement, your negligence, your use of the Platform, or any violation of third-party rights.


21. Force Majeure

GameTrade isn’t liable for delays/failures due to events beyond our control. Such events may include, but are not limited to, natural disasters, war, civil unrest, governmental actions, system failures, cyber-attacks, or disruptions in third-party services.


22. Suspension and Termination

GameTrade may suspend/terminate your Account for:

  • Breaching this Agreement (unremedied within 30 days).
  • Fraudulent activity or reputational harm.
  • Inactivity for over 1 year (forfeiting GT Credit/Points).
  • Insolvency or bankruptcy proceedings.
  • Upon termination, cease Platform use and return/destroy Confidential Information. Users forfeit any claims to refunds or credits upon termination.

23. Variation

GameTrade may modify this Agreement, effective 14 days after posting. If you do not agree to the revised terms, you may terminate your Account by notifying GameTrade in writing before the effective date of the changes. Continued use of the Platform after the effective date constitutes acceptance of the updated Agreement.


24. Notices

Notices are sent via Platform notifications, email ([email protected]), or post to [Insert Address]. They’re deemed received per standard communication protocols.


25. GT Credit and GT Points

GT Credit is for Platform purchases, non-redeemable for cash. GT Points are earned via activities and convertible to GT Credit. Both are non-transferable and subject to program changes. GameTrade reserves the right to modify, suspend, or discontinue the GT Credit and GT Points programs at any time, with or without notice. Accrued points or credits may expire or be forfeited in accordance with program rules.


26. AML/CTF Compliance

GameTrade complies with Hong Kong’s Cap. 615 via EKYC, transaction monitoring, and reporting to the Joint Financial Intelligence Unit (JFIU). Provide ID documents as requested; non-compliance may lead to suspension.


27. Prohibited Conduct

Do not:

  • Violate laws or intellectual property rights.
  • Engage in fraud, price manipulation, or off-Platform transactions.
  • Use VPNs to bypass restrictions without consent.
  • Distribute spam or malware.

28. Dispute Resolution

Resolve disputes directly with users. GameTrade may mediate, with decisions binding. You agree that any dispute arising out of or relating to this Agreement or your use of the Platform shall be resolved through binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC), in accordance with its rules. The arbitration shall take place in Hong Kong and be conducted in English.


29. Survival

Certain provisions of this Agreement, including those relating to indemnity, confidentiality, intellectual property, and dispute resolution, shall survive termination of your Account or this Agreement.


30. General

  • Governing Law: Hong Kong law, with exclusive jurisdiction in Hong Kong courts.
  • Severability: Invalid provisions don’t affect others.
  • No Waiver: Failure to enforce rights isn’t a waiver.
  • No Partnership: This Agreement creates no partnership or agency.
  • No Third-Party Rights: Only parties to this Agreement have rights.
  • English Prevalence: The English version controls.
  • Entire Agreement: This Agreement constitutes the entire understanding between the parties, superseding all prior agreements or understandings.
